TERMS.txt

last_modified: October 18, 2026

Welcome to Nerd Rage Studio, a Detroit-based sole proprietorship making custom art, handmade goods, digital resources, and other strange things that escaped the workshop.

These Terms and Conditions govern your use of nerdrage.studio, customer accounts, shop purchases, digital downloads, preorders, and custom commissions.

By creating an account, placing an order, purchasing a download, approving a commission quote, or otherwise agreeing to these terms during checkout, you agree to these Terms and Conditions, our Privacy Policy, and our Shipping and Returns Policy.

If you do not agree, please do not place an order. Awkward now is better than legally awkward later.

WHO MAY USE THE SHOP

You must be at least 18 years old and legally able to enter a binding agreement.

Anyone under 18 may use the shop only with the permission and supervision of a parent or legal guardian. The parent or guardian must place the order and accept these terms.

The site is not intended for children under 13.

CUSTOMER ACCOUNTS

You agree to provide accurate, current information when creating an account, placing an order, or requesting a commission.

You are responsible for:

  • Protecting your password and two-factor backup codes

  • Maintaining control of your account

  • Keeping your email address current

  • Informing us promptly about unauthorized access

  • All activity performed through your account unless caused by our failure to use reasonable security

You may not impersonate another person, create accounts for fraudulent purposes, interfere with the website, upload malicious files, scrape the site without permission, or attempt to access systems or information that do not belong to you.

We may suspend or close an account used for fraud, abuse, harassment, security attacks, unlawful activity, or other conduct that threatens the studio, its customers, or the website.

Closing an account does not cancel an existing order, erase an unpaid balance, or remove records we must retain for taxes, disputes, or legal compliance.

SHOP ORDERS

An item appearing in the shop is an invitation to place an order, not an eternal blood oath that the item will remain available.

An order is accepted after:

  • You provide the required information

  • Payment is successfully authorized

  • We confirm that the item is available and can be fulfilled

We may refuse, limit, or cancel an order when:

  • The item is unavailable

  • Payment cannot be verified

  • The order appears fraudulent

  • The shipping address is invalid or unsupported

  • The product was listed with an obvious pricing or description error

  • Fulfilling the order would violate a law, third-party right, or studio policy

  • Circumstances outside our reasonable control prevent fulfillment

If we cancel a paid order before fulfillment, we will issue a full refund for the canceled item.

PRICES, TAXES & PAYMENT

Prices are shown in United States dollars unless stated otherwise.

Prices may change before checkout. Once an order is accepted, its price will not change unless you request a modification or both sides agree to an updated commission quote.

Applicable taxes, shipping charges, and other disclosed costs are added during checkout.

Payments are processed through Stripe and available wallet providers. We do not store full card numbers or CVC codes.

You agree that the payment information submitted is accurate and that you are authorized to use the selected payment method.

If you believe a charge is incorrect, contact orders@nerdrage.studio before initiating a chargeback so we have an opportunity to investigate. This does not limit any dispute rights provided by law or your payment provider.

SHIPPING, RETURNS & FINAL SALE ITEMS

Processing times, shipping rates, delivery problems, eligible returns, exchanges, store credit, and final-sale categories are explained in our Shipping and Returns Policy.

That policy is part of these terms.

Original artwork, commissions, digital products, gift cards, clearance items, and products marked final sale may have additional restrictions.

If a product page, commission quote, or preorder listing contains terms specific to that item, those specific terms control over a conflicting general description in these terms, except where prohibited by law.

PREORDERS & MADE-TO-ORDER PRODUCTS

A preorder or made-to-order product page will state its estimated production or shipping window.

Unless the listing says otherwise, payment is collected when the order is placed.

Production and shipping dates are good-faith estimates based on the information available at launch. If we cannot ship within the stated window, we will provide an updated estimate and the choice to accept the delay or cancel the unshipped order for a full refund.

Additional preorder cancellation or final-sale conditions will be disclosed on the product page before purchase.

PROMOTIONS, DISCOUNTS & GIFT CARDS

Promotions, discount codes, giveaways, free-shipping offers, and similar programs may have additional rules displayed with the offer.

Unless stated otherwise:

  • Discounts cannot be combined

  • Codes have no cash value

  • Promotions cannot be applied retroactively

  • Offers may be limited by product, location, quantity, or date

  • Fraudulent, duplicated, transferred, or improperly obtained codes may be canceled

  • Gift cards are governed by the conditions shown when purchased and applicable law

We may modify or end a promotion before an order is placed. We will not retroactively remove a valid promotion from an accepted order.

CUSTOM COMMISSION REQUESTS

Submitting a commission request does not guarantee acceptance.

A commission begins as a request and quote, not a booked order. We choose projects based on creative interest, studio capacity, technical fit, safety, legality, and whether we can do the idea justice.

We may decline any project for any lawful reason.

More detail produces a more accurate quote. You are responsible for providing correct information about:

  • The requested item and design

  • Size, measurements, model, or compatibility

  • Intended use

  • Budget

  • Required deadlines

  • Customer-provided base items

  • Reference images

  • Any other requirement that could affect the work

We are not responsible for problems caused by inaccurate or incomplete information supplied by the customer.

CONCEPT DEPOSIT & DIGITAL MOCKUP

Once a commission quote is accepted, a non-refundable concept deposit of approximately 3% to 5% of the quoted project price may be required before mockup work begins.

The concept deposit pays for the time spent developing the digital mockup and is credited toward the later 50% production deposit. It is not an extra fee stacked on top of the project price.

Digital mockups are generally delivered within the estimate stated in the quote or commission process. Timelines may change based on studio workload, project complexity, customer response time, and circumstances outside our reasonable control.

COMMISSION REVISIONS

A commission includes up to two rounds of reasonable mockup revisions unless the quote states otherwise.

A revision round means one collected set of changes submitted together. Sending seventeen separate messages because another idea arrived while brushing your teeth does not create seventeen free revision rounds.

Reasonable revisions may include adjustments to:

  • Color

  • Placement

  • Small design details

  • Text

  • Other elements within the approved direction

The following may require a new quote, additional payment, or a restarted timeline:

  • A new concept or creative direction

  • Changing the base item

  • Changing the size or model

  • Major composition changes

  • Additional characters or design elements

  • Requests made after the design was approved

  • Requests made after production began

We will explain any additional cost before performing work outside the approved scope.

DESIGN APPROVAL & PRODUCTION DEPOSIT

You must approve the final mockup or written project specification before production begins.

Approval confirms that the design, spelling, colors, placement, size, base item, and overall direction are acceptable.

After approval, a 50% production deposit is required to reserve the commission slot and purchase materials or the base item. The concept deposit is credited toward this amount.

If you cancel after paying the production deposit, half of the total production deposit is non-refundable. The remaining half will be returned to the original payment method.

Completed and approved commissions are final sale.

If Nerd Rage Studio must cancel a commission, you will be refunded for any unfinished portion of the project and any unused production deposit.

PRODUCTION & PROGRESS UPDATES

Production estimates are based on the project’s size, complexity, materials, current workload, and any timeline stated in the quote.

They are estimates, not a promise that time itself will behave.

We will provide progress updates when reasonably possible. Progress photographs are informational and do not reopen the approved design for additional revisions.

A delay caused by missing information, unpaid invoices, approval delays, customer-requested changes, unavailable materials, or a customer-supplied item pauses or extends the project timeline.

FINAL APPROVAL & PAYMENT

When the commission is finished, we will provide final photographs or another reasonable opportunity to review the completed piece.

The remaining balance must be paid before the piece ships.

Final payment is due within 30 calendar days of the final invoice. We will send at least one reminder before the deadline.

If payment is not received within 30 days:

  • The order may be canceled

  • The commission may be considered abandoned

  • Amounts already paid may be retained to cover labor, materials, and the base item

  • Nerd Rage Studio may retain or repurpose the unfinished or completed piece, subject to applicable law

Please do not make us hold your art baby hostage. It makes the workshop tense.

CUSTOMER-SUPPLIED ITEMS

Do not ship a base item until the commission has been accepted and you have received shipping instructions.

The customer is responsible for:

  • Shipping the item to Nerd Rage Studio

  • Using a trackable shipping service

  • Packaging it safely

  • Choosing whether to purchase insurance

  • Confirming that the item is authentic, lawful to possess, and suitable for customization

The risk of loss or shipping damage remains with the customer and carrier until the item is delivered to Nerd Rage Studio.

We are not responsible for:

  • Pre-existing damage

  • Hidden defects

  • Counterfeit items

  • Manufacturer defects

  • Material deterioration

  • Failures caused by age, previous use, improper storage, or incompatible materials

  • Problems that could not reasonably be discovered before work began

We will use reasonable care while an item is in our possession.

If we directly damage a customer-supplied item through our negligence, our maximum responsibility will be its documented fair-market value immediately before customization, to the extent permitted by law.

Sentimental value is real, but it is not something an insurance claim knows how to calculate. Do not ship an irreplaceable heirloom without discussing the risk first.

SIZING, MODELS & COMPATIBILITY

You are responsible for selecting or providing the correct size, model, dimensions, and compatibility information.

Custom footwear and apparel cannot be returned because the customer selected the wrong size.

Custom controllers, systems, accessories, and base items may work only with specific hardware, software, models, or regions. Review the product description and ask questions before approving the project.

FUNCTIONAL, WEARABLE & DISPLAY-ONLY ITEMS

Each applicable product page or commission quote will identify whether an item is:

  • Functional

  • Wearable

  • Decorative

  • Display-only

  • Modified in a way that may affect its original manufacturer warranty

Do not ride, wear, connect, power on, wash, or otherwise use an item marked display-only.

Modifying shoes, clothing, controllers, consoles, skateboards, and other products may void the original manufacturer’s warranty. Nerd Rage Studio is not authorized to provide warranty service on behalf of the original manufacturer.

Unless expressly stated, manufacturers and trademark owners are not affiliated with or responsible for our customization work.

CARE, WEAR & HANDMADE VARIATIONS

Handmade work contains natural variations. Small differences in color, brushwork, placement, stitching, texture, finish, and materials are normal and are not defects.

Screens and photographs also display colors differently. We make reasonable efforts to represent products accurately, but an exact color match cannot be guaranteed.

Custom paint, coatings, fabric, leather, hardware, and other materials will change with use and time. Protective coatings improve durability but do not make an item immortal.

Normal wear may include:

  • Creasing

  • Scuffing

  • Fading

  • Surface wear

  • Sole wear

  • Fabric pilling

  • Minor changes in finish

  • Damage caused by friction or repeated flexing

You must follow all care instructions supplied with the item. Improper cleaning, machine washing, soaking, harsh chemicals, extreme heat, excessive moisture, abrasion, modification, or use outside the stated purpose may damage the work.

Failure to follow care instructions may make the item ineligible for a workmanship claim.

30-DAY LIMITED WORKMANSHIP WARRANTY

Custom commissions include a 30-day limited workmanship warranty beginning on the recorded delivery date.

This limited warranty covers a verified failure caused by our customization workmanship during ordinary, intended use.

It does not cover:

  • Normal wear and aging

  • Accidents, drops, impacts, or abuse

  • Improper cleaning or storage

  • Water, heat, chemicals, or excessive moisture

  • Failure to follow care instructions

  • Customer alterations or third-party repairs

  • Incorrect sizing or compatibility information

  • Pre-existing or hidden defects in a base item

  • Original manufacturer defects

  • Damage caused by using a decorative or display-only item functionally

  • Theft, loss, or shipping damage reported outside the applicable reporting window

To make a claim, email orders@nerdrage.studio within 30 calendar days of delivery. Include the order number, a description of the problem, and clear photographs or video.

If the claim is covered, Nerd Rage Studio will choose an appropriate remedy based on the item and circumstances. This may include:

  • Touch-up or repair

  • Replacement when reasonably possible

  • Store credit

  • A refund when another remedy is not reasonable

We will cover reasonable approved shipping costs for a valid workmanship claim.

This is a limited warranty. It does not guarantee that a wearable or functional item will remain unchanged through unlimited use.

This warranty gives you specific legal rights. You may also have other rights that vary by state. Nothing in these terms limits a right that cannot legally be limited.

OWNERSHIP OF PHYSICAL ARTWORK

After full payment, you own the finished physical item.

You may display, wear, use, gift, or resell that individual physical item, subject to its intended-use limitations.

Ownership of the physical item does not transfer copyright, trademark rights, source files, or reproduction rights.

You may not, without written permission:

  • Manufacture copies of the design

  • Sell prints or merchandise using the design

  • Distribute mockups or production files

  • License the design to another person

  • Claim authorship of the artwork

  • Use the artwork as a logo, brand identity, or commercial character

  • Turn the design into a product line

A separate written license may be available for commercial rights.

STUDIO INTELLECTUAL PROPERTY

To the extent we legally own them, Nerd Rage Studio retains all rights in:

  • Original artwork and design elements

  • Sketches

  • Mockups

  • Unused concepts

  • Source files

  • Templates

  • Product photography

  • Process photographs and video

  • Written content

  • Website design

  • Branding

  • Logos

  • Studio-created documentation

Mockups, rejected concepts, editable files, layered files, and production resources are not included with a physical commission unless the quote expressly says otherwise.

CUSTOMER-PROVIDED MATERIALS

You confirm that you own or have permission to share any reference image, photograph, logo, text, character design, or other material submitted to us.

You grant Nerd Rage Studio a limited permission to copy, edit, and use those materials only as reasonably necessary to:

  • Review the request

  • Prepare a quote

  • Create mockups

  • Produce the commissioned item

  • Communicate about the project

  • Maintain required business records

You remain responsible for the materials you provide.

To the extent permitted by law, you agree to reimburse Nerd Rage Studio for reasonable losses, claims, or costs resulting from material you submitted without the necessary rights or permission.

THIRD-PARTY CHARACTERS, BRANDS & FAN ART

Some projects may be inspired by or depict third-party characters, games, films, music, logos, sports teams, products, or other popular culture.

All third-party copyrights, trademarks, characters, names, and logos remain the property of their respective owners.

Unless expressly stated, Nerd Rage Studio is not affiliated with, sponsored by, licensed by, or endorsed by those owners.

Purchasing a third-party-inspired piece does not grant you permission to reproduce it, manufacture merchandise from it, use it commercially, or claim ownership of the underlying character or brand.

We may refuse, cancel, remove, or modify any project that creates a legal, ethical, platform, or business concern.

No amount of tiny legal text transforms us into the official merchandising department for a mutant turtle.

PORTFOLIO & PROCESS DOCUMENTATION

Unless you request confidentiality in writing before production begins, Nerd Rage Studio may photograph or record the finished physical artwork and use those images in:

  • The studio portfolio

  • Social media

  • Videos and livestreams

  • Educational content

  • Process documentation

  • Advertising and promotional materials

We will not publish your name, address, private messages, submitted personal photographs, or other identifying information without separate permission.

Confidentiality requests may affect whether a project is accepted or whether a different quote is required.

DIGITAL-PRODUCT LICENSE

Unless a product page provides a different license, purchasing a digital product grants one purchaser a non-exclusive, non-transferable license to use the files.

You may:

  • Use the files for personal projects

  • Use the files to create original finished artwork

  • Use original finished artwork in commercial projects

  • Sell completed, flattened, or otherwise non-extractable finished work

  • Use finished work in client projects, books, games, maps, prints, and merchandise

The digital product must be incorporated into a larger original work and cannot remain extractable as a standalone resource.

You may not:

  • Sell, share, gift, or redistribute the original files

  • Upload the files to a shared drive, asset library, marketplace, or stock website

  • Resell a template, brush, graphic, or resource with only minor changes

  • Include the editable files in a product sold or delivered to someone else

  • Sublicense the files

  • Claim authorship of the underlying resource

  • Use the files to create a directly competing asset pack

  • Use the files to train, fine-tune, evaluate, or supply a dataset for an artificial-intelligence or generative model

  • Remove copyright, license, or attribution information included with the files

Unless a product page grants a team license, the license covers one individual user.

Digital products are final sale after delivery, except when the file is corrupt and we cannot provide a working replacement.

PROHIBITED USE OF THE WEBSITE

You may not use the website or its content to:

  • Break any law

  • Commit fraud

  • Infringe intellectual-property rights

  • Harass, threaten, or impersonate another person

  • Upload malware or harmful code

  • Probe or bypass security

  • Interfere with site operation

  • Collect customer or account information

  • Use automated scraping or extraction without written permission

  • Copy or reproduce the website for a competing service

  • Submit false payment disputes

  • Abuse promotions, refunds, or account systems

We may block access, cancel affected orders, preserve evidence, and report unlawful activity when appropriate.

THIRD-PARTY SERVICES & LINKS

The website uses or links to third-party services, including payment providers, shipping carriers, social platforms, authentication providers, Discord, and other external websites.

We do not control their availability, content, security, or privacy practices.

Use of a third-party service is governed by that provider’s terms and policies.

SERVICE AVAILABILITY

We may update, suspend, change, or discontinue part of the website when reasonably necessary.

We do not guarantee uninterrupted access. Hosting failures, maintenance, attacks, carrier problems, material shortages, equipment failures, power outages, natural disasters, acts of government, labor disruptions, and other events outside our reasonable control may delay or prevent performance.

When one of these events affects a paid order, we will communicate with you and provide any cancellation or refund option required by law.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Nerd Rage Studio is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website, an order, a product, a commission, or a digital download.

To the fullest extent permitted by law, our total liability for a claim will not exceed the amount you paid Nerd Rage Studio for the specific product or service that caused the claim.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited, including certain claims involving personal injury, gross negligence, willful misconduct, fraud, or nonwaivable consumer rights.

Some jurisdictions do not permit certain liability limits. In those jurisdictions, the limits apply only to the maximum extent allowed.

INFORMAL DISPUTE RESOLUTION

Before filing a lawsuit, you agree to email legal@nerdrage.studio with:

  • Your name

  • Order or commission number

  • A clear description of the dispute

  • The resolution you are requesting

  • Any relevant documentation

Both sides agree to make a good-faith attempt to resolve the dispute for at least 30 days after the notice is received.

This requirement does not prevent either side from seeking urgent injunctive relief, filing an eligible small-claims case, meeting a legal deadline, or exercising a right that cannot be waived.

GOVERNING LAW & COURTS

These terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Any lawsuit that is not eligible for small-claims court must be brought in an appropriate state or federal court serving Wayne County, Michigan, unless applicable law requires another location.

Small-claims court remains available when the claim qualifies.

These terms do not require private arbitration and do not waive the right to participate in a class action where that right applies.

CHANGES TO THESE TERMS

We may update these terms when the shop, services, technology, or law changes.

The current version will be posted with a revised effective date.

The version in effect when an order is placed generally governs that order. Material changes will not be applied retroactively when doing so would unfairly reduce an existing customer right.

Continued use of the website after updated terms take effect means the updated terms govern future use and future purchases.

SEVERABILITY

If part of these terms is found invalid or unenforceable, the remaining portions will continue in effect.

The invalid portion will be limited or modified only as much as necessary to make it enforceable where allowed.

NO WAIVER

If we do not enforce a provision immediately, that does not permanently waive our right to enforce it later.

One act of mercy does not become binding studio law.

ENTIRE AGREEMENT

These terms, the applicable product page, an accepted commission quote, the Shipping and Returns Policy, and any other written terms expressly incorporated into the purchase form the agreement between you and Nerd Rage Studio.

If an accepted commission quote conflicts with these general terms, the specific written quote controls for that project unless prohibited by law.

Verbal conversations, social messages, and informal discussions do not change the agreement unless the change is confirmed in writing.

ELECTRONIC COMMUNICATIONS

You agree that order confirmations, receipts, invoices, approvals, notices, and other transaction-related communications may be provided electronically.

You are responsible for keeping your email address current and checking messages related to active orders and commissions.
